Introduction

Welcome to Cloud Storage Browser. Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the Cloud Storage Browser desktop application ("the Application") operated by tan mally ("us", "we", "our") based in Bangalore, India.

Your access to and use of the Application is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Application.

By downloading, installing, or using the Application, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not use the Application.

1. Use of the Application

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Application for your personal or internal business purposes.

1.2 Restrictions

You agree not to:

Modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the Application
Remove, obscure, or alter any proprietary notices or labels on the Application
Use the Application for any illegal purpose, or in violation of any local, state, national, or international law
Interfere with or disrupt the integrity or performance of the Application
Attempt to gain unauthorized access to the Application or its related systems or networks
Use the Application to store or transmit malicious code or infringing, libelous, or otherwise unlawful or tortious material
Use the Application to violate the legal rights (including the rights of privacy and publicity) of others

2. User Accounts and Security

2.1 Account Security

You are responsible for safeguarding your device and any credentials used with the Application. You agree that you will not disclose your credentials to any third party and will take sole responsibility for any activities or actions that occur on your device, whether or not you have authorized such activities or actions.

2.2 Security Incidents

You agree to notify us immediately of any unauthorized access to or use of the Application. We cannot and will not be liable for any loss or damage arising from your failure to comply with this section.

3. Intellectual Property

3.1 Ownership

The Application and its original content, features, and functionality are and will remain the exclusive property of tan mally and its licensors. The Application is protected by copyright, trademark, and other laws of both India and foreign countries.

3.2 Feedback

Any feedback, comments, or suggestions you may provide regarding the Application is entirely voluntary, and we will be free to use such feedback, comments, or suggestions as we see fit and without any obligation to you.

4. Disclaimers

4.1 "As Is" and "As Available"

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

4.2 No Warranty

TAN MALLY AND ITS AFFILIATES DO NOT WARRANT THAT: (A) THE APPLICATION WILL FUNCTION UNINTERRUPTED, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; (B) ANY ERRORS OR DEFECTS WILL BE CORRECTED; (C) THE APPLICATION IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (D) THE RESULTS OF USING THE APPLICATION WILL MEET YOUR REQUIREMENTS.

4.3 Data Responsibility

YOU ARE SOLELY RESPONSIBLE FOR ALL OF YOUR DATA AND CONTENT ACCESSED OR STORED THROUGH THE APPLICATION. YOU ARE RESPONSIBLE FOR BACKING UP YOUR DATA INDEPENDENTLY OF THE APPLICATION.

5. Limitation of Liability

5.1 Limitation of Liability

IN NO EVENT SHALL TAN MALLY, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APPLICATION; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APPLICATION; (C) ANY CONTENT OBTAINED FROM THE APPLICATION; AND (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

5.2 Cap on Liability

IN JURISDICTIONS WHERE THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES IS NOT ALLOWED, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

6. Indemnification

You agree to defend, indemnify, and hold harmless tan mally and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (a) your use of and access to the Application; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (d) any claim that your actions caused damage to a third party.

7. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Application after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Application.

8. Termination

8.1 Termination by You

You may terminate these Terms by uninstalling the Application from all devices where you have installed it.

8.2 Termination by Us

We may terminate or suspend your access to the Application immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

8.3 Effect of Termination

Upon termination, your right to use the Application will immediately cease.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.

10. Dispute Resolution

Any disputes relating to these Terms or the Application shall be subject to the exclusive jurisdiction of the courts in Bangalore, India.

11. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

12. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

13. Entire Agreement

These Terms constitute the entire agreement between us regarding our Application and supersede and replace any prior agreements we might have between us regarding the Application.

14. Export Control

You agree to comply with all applicable export and re-export control laws and regulations, including the Export Administration Regulations maintained by the U.S. Department of Commerce, and trade and economic sanctions maintained by the Treasury Department's Office of Foreign Assets Control.

15. Updates and Upgrades

We may from time to time provide updates or upgrades to the Application, but we have no obligation to do so. Such updates and upgrades shall be subject to these Terms unless other terms are provided with the updates or upgrades, in which case those terms shall apply.
